{"id":1189,"date":"2020-11-11T23:46:55","date_gmt":"2020-11-12T05:46:55","guid":{"rendered":"https:\/\/themonroefoundation.org\/business\/?p=1189"},"modified":"2020-11-11T23:46:57","modified_gmt":"2020-11-12T05:46:57","slug":"report-to-commissioner-brandon-johnson","status":"publish","type":"post","link":"https:\/\/themonroefoundation.org\/business\/blog\/report-to-commissioner-brandon-johnson\/","title":{"rendered":"Report To Commissioner Brandon Johnson"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/themonroefoundation.org\/business\/wp-content\/uploads\/2020\/11\/Commissioner_Brandon_Johnson.png\" alt=\"\" class=\"wp-image-1190\" width=\"704\" height=\"897\" srcset=\"https:\/\/themonroefoundation.org\/business\/wp-content\/uploads\/2020\/11\/Commissioner_Brandon_Johnson.png 704w, https:\/\/themonroefoundation.org\/business\/wp-content\/uploads\/2020\/11\/Commissioner_Brandon_Johnson-235x300.png 235w\" sizes=\"(max-width: 704px) 100vw, 704px\" \/><\/figure>\n\n\n\n<p><strong>GET CLEARED, ILLINOIS<\/strong><\/p>\n\n\n\n<p><strong>The following describes one of the most immediate as well as one of&nbsp; the long-term structural goals.<\/strong><\/p>\n\n\n\n<p><strong>***<\/strong><\/p>\n\n\n\n<p><strong><u>Short Term Immediate Goal<\/u><\/strong><strong>: Enlisting additional judges to sign orders&nbsp; for uncontested petitions on an ongoing, regular basis.<\/strong><\/p>\n\n\n\n<p><strong>Background:<\/strong><\/p>\n\n\n\n<p>Per the Illinois expungement and sealing statute (20ILCS 2630\/Criminal Identification Act) the only time the court is required to set a date for a hearing is <em><u>if\/when<\/u> <\/em>an objection has been filed.<\/p>\n\n\n\n<p>If no objection has been filed discretionary relief is warranted so on a regular basis a <em>p<u>ool of<\/u> j<u>udges could sign uncontested petitions to expunge or seal. <\/u><\/em>This would more immediately&nbsp; address a high volume of uncontested petitions that are still currently being heard by a&nbsp; presiding judge, and formally read into the record on scheduled court calls.<\/p>\n\n\n\n<p>*****<\/p>\n\n\n\n<p><strong><u>Long Term Goal<\/u><\/strong>: <strong>Having additional judges permanently assigned to&nbsp; hear contested petitions (those with objections) on more than two&nbsp; days a week.<\/strong><\/p>\n\n\n\n<p><strong>Background:<\/strong><\/p>\n\n\n\n<p>With uncontested petitions being handled administratively, and <em><u>additional court dates and <\/u>&nbsp;j<u>udges to hear only those petitions that are required to be set for hearing<\/u><\/em>, this would address&nbsp; both the current backlog and work towards lowering the current wait time <em><u>of approximately <\/u>&nbsp;<u>one year<\/u> <\/em>for a petition to be heard.<\/p>\n\n\n\n<p>Currently, one organization, Legal Aid Chicago has over <em><u>40 petitions pending that were filed <\/u>&nbsp;<u>between 11 and 14 months ago<\/u><\/em>. <em><u>To date, they have received no notice of objections or hearings <\/u>&nbsp;<u>on these petitions<\/u><\/em>. <em><u>They have over 75 petitions that were filed prior to March 2020 (over 8 <\/u>&nbsp;<u>months ago)<\/u><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>GET CLEARED, ILLINOIS The following describes one of the most immediate as well as one of&nbsp; the long-term structural goals. *** Short Term Immediate Goal: Enlisting additional judges to sign orders&nbsp; for uncontested petitions on an ongoing, regular basis.
